Drinking, Driving, and Sleeping

I saw in the Daily Times there was a small article about a Ralphell Jamison being found allegedly asleep behind the wheel of his vehicle with the engine running at 3 in the morning. He failed a sobriety check and was charged with driving under the influence.

Now I assume the vehicle was parked and if the engine was running I have no problem with him being given a ticket as obviously he was planning to drive (too warm to say he needed the heater on). However I have known people who had been drinking and simply slept in their car (engine not running and parked) in order to sober up before driving and they were given a ticket for being under the influence. If they don't have the keys in ignition there is no reason to think they are a hazard to anyone and it is just an outcome of too many laws being passed and the police being shits about it.
